Dignidad humana y derechos fundamentales. Consideraciones en torno al concepto De Dignidad En La Reciente Doctrina Del Tribunal Europeo De Derechos Humanos Y Del Tribunal De Justicia De La Unión Europea

La dignidad humana constituye un valor destacado en los derechos reconocidos tanto en el Convenio Europeo de Derechos Humanos como en la Carta de los Derechos Fundamentales de la Unión Europea. Tras una breve introducción sobre la relevancia jurídica de la dignidad humana, este artículo se centra en el análisis de este concepto en la doctrina del Tribunal Europeo de Derechos Humanos sobre el derecho a la vida, la prohibición de la tortura, la prohibición de la esclavitud y del trabajo forzado, el derecho al respeto a la vida privada y familiar, etc. A continuación, los autores examinan la dignidad humana desde la perspectiva del Tribunal de Justicia de la Unión Europea, analizando la implementación de este valor antes y después de la entrada en vigor del Tratado de Niza. Este estudio concluye con algunas consideraciones sobre la importancia de la dignidad humana como derecho fundamental, valor fundacional de la Unión Europea y criterio interpretativo de los demás derechos reconocidos en el ámbito europeo.

Human dignity constitutes a value recognized in the rights enshrined in both the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union. After a brief introduction on the legal relevance of human dignity, this article focuses on the analysis of this concept in the doctrine of the European Court of Human Rights in relation to the right to life, the prohibition of torture, the prohibition of slavery and forced labor, the right to respect for private and family life, etc. The authors then analyze human dignity from the perspective of the Court of Justice of the European Union, examining the implementation of this value before and after the entry into force of the Treaty of Nice. This study concludes with some considerations on the importance of human dignity as a fundamental right, as a founding value of the European Union and as an interpretative standard for the other rights granted in the European territory.
