El reconocimiento jurídico de la identidad de género en América Latina: Reflexiones y aprendizajes para el debate jurídico español. Legal recognition of gender identity in Latin America: Reflections and lessons for the Spanish legal discusión

En España, el debate jurídico sobre los derechos de las personas trans y la posible colisión de estos con otros intereses jurídicamente protegidos se ha visto avivado con la reciente aprobación, por parte del Consejo de Ministros, del proyecto de Ley para la igualdad real y efectiva de las personas trans y para la garantía de los derechos de las personas LGTBI. En este contexto, el presente trabajo se propone conocer cuál es la realidad jurídica de las personas del colectivo trans más allá de nuestras fronteras, concretamente, dentro del Sistema Interamericano de Derechos Humanos, con el principal fin de encontrar herramientas y claves interpretativas que, desde las legislaciones y los conflictos jurídicos de los países analizados, aporten aprendizajes al debate jurídico español.

Spanish legal discussion on the rights of transgender people and the possible collision with other legally protected interests has been fuelled by the recent approval, by the Council of Ministers, of the draft Law for the real and effective equality of transgender people and for the guarantee of the rights of LGTBI people. In this context, this paper sets out to find out what the legal reality of trans people is beyond our borders, specifically, within the Inter-American Human Rights System, with the main aim of finding tools and interpretative keys which, from the legislation and legal conflicts of the countries analysed, provide lessons for the Spanish legal debate.
