El objetivo del presente artículo es establecer un marco general de reflexión acerca de (una parte de) la cadena de generación del Derecho. Para cumplimentar este propósito se van a tomar tres elementos -el concepto de Derecho, la función del Derecho y la necesidad de Derecho- que se pondrán en relación entre sí para establecer el engranaje de dicha cadena de generación. Dejamos fuera de la cadena de generación la parte administrativa de la producción legislativa. Igualmente el artículo elaborará en torno a cómo el orden y la prelación de cada uno de estos tres elementos en dicha secuencia tienen implicaciones no menores. El análisis de este asunto es relevante porque la disposición errónea o la ausencia de dicho orden puede tener consecuencias no baladíes a la hora de entender cualquiera de los tres elementos citados, especialmente el propio concepto de Derecho.

The aim of this article is to establish a general framework that permits to refl ect on (one part) of the so-called “law’s supply chain”. To this end, three elements -the concept of law, the function of law and the necessity of law- will be put in relation with each other in order to establish the chain of generation of law. We leave out of the chain of generation the part of the administrative tasks of the legislative production. Th e article will also elaborate on how the order and priority of each of these three elements of this sequence have implications that are not minor. Th e analysis of this issue is relevant because the erroneous arrangement or the lack of such an order and priority may have far-reaching consequences that are not trivial when it comes to understanding any of the three elements mentioned, especially the concept of law.
