Sobre la base de «La estructura de la persona humana» de Edith Stein, este estudio nos permitirá abordar una visión de la justicia restaurativa en relación con la necesidad existencial de poseer una concepción del hombre para el ejercicio de toda profesión jurídica. De esta concepción del hombre emanan los fundamentos filosóficos de la justicia restaurativa en relación con la transformación del mal, la libertad y la responsabilización, la reparación del daño causado por el delito y la reinserción. El primero de los objetivos es establecer un marco que introduzca someramente la idea de justicia restaurativa y cómo esta opera en el ordenamiento jurídico español. Tras ello, sobre la base del trabajo de Stein, abordaremos las dimensiones del hombre y cómo estas construyen las bases filosóficas del trabajo restaurativo propuesto a víctimas, victimarios y representantes de la comunidad para que estos puedan reconocer la profundización que puede llegar a plantear la justicia restaurativa. En este sentido, se pretende abordar cómo el trabajo sobre la persona dentro del paradigma restaurativo posibilita la comprensión y vivencia de los anhelos que, como humanidad, plasmamos en el primer considerando y en el artículo 1 de la Declaración de Derechos Humanos de 1948. Por último, y siguiendo el trabajo de Edith Stein, nos centraremos en sacar unas breves conclusiones acerca de la necesidad de tener una concepción de la persona humana para el ejercicio de la profesión jurídica sobre la base de la relación entre la justicia restaurativa y las dimensiones del hombre.    

Based on “Th e structure of the human person” by Edith Stein, this study will allow us to address a vision of restorative justice in relation to the existential need to have a conception of the human person for the exercise of any legal profession. From this conception of man emanate the philosophical foundations of restorative justice in relation to the transformation of evil, freedom and responsibility, repair of the damage caused by crime and reintegration. Th e fi rst objective is to establish a framework that briefl y introduces the idea of restorative justice and how it operates in the Spanish legal system. Aft er that, based on Stein’s work, we will address the dimensions of man and how these build the philosophical bases of the restorative work proposed to victims and perpetrators so that they can recognize the sense of otherness and responsibility as keys to restorative justice. In this sense, the aim is to understand how work on the person within the restorative paradigm is necessary for the understanding and living of the desires that as humanity we express in the fi rst recital and in article 1 of the Declaration of Human Rights of 1948. Finally, and following the work of Edith Stein, we will focus on drawing some brief conclusions based on the relationship between restorative justice and the dimensions of man, about the need to have a conception of the human person for the exercise of justice. legal profession.
