En el asunto Eqiom, el Tribunal de Justicia de la Unión Europea ha tenido la oportunidad de declarar la incompatibilidad de la normativa francesa antiabuso aplicable en el marco de la Directiva Matriz-Filial con la propia Directiva y con la libertad de establecimiento. La normativa francesa establecía una presunción general de fraude o abuso para todas las distribuciones de dividendos a entidades residentes en un Estado miembro que estuvieran controladas por personas residentes en un tercer Estado. Según el TJUE, dicha presunción va más allá de lo necesario para luchar contra montajes puramente artificiales orientados a disfrutar indebidamente de las ventajas fiscales previstas en la Directiva. Esta sentencia es especialmente relevante para España en la medida en que la normativa española es sustancialmente idéntica a la francesa.

In its judgment in the case Eqiom, the Court of Justice of the European Union has declared the French anti-abuse provision applicable in the context of the Parent-Subsidiary Directive incompatible with both the Directive and the freedom of establishment. The French regulations established a general presumption of tax avoidance or evasion with respect to all dividend distributions to EU parent companies controlled by non-member States residents. According to the Court of Justice, this presumption goes beyond what it is needed to fight against wholly artificial arrangements aimed to wrongfully benefit from the tax advantages contained in the Directive. This judgment is especially relevant for Spain as domestic legislation implementing this anti-abuse provision is substantially identical to its French equivalent.
