El texto aborda comparativamente los sistemas de garantías de derechos fundamentales en la Constitución española de 1978 y en la Constitución chilena de 1980. Por ello, expondremos qué entendemos como un sistema de garantías de derechos. Posteriormente, analizaremos las principales características del sistema de garantías de cada Carta Fundamental, para luego concluir cómo sus principales diferencias se deben a la distinta configuración del sistema político y judicial.

This article tries to approach a comparison between the Fundamental Right’s guarantee systems on the 1978 Spanish Constitution and the 1980 Chilean Constitution. On that matter, we’ll show what we understand as a Fundamental Right’s guarantee system. Afterwards, we shall analyze the main elements of each Constitution’s guarantee system, exposing how their main differences can be explain in the different configuration of the political and judicial system.
