La nueva Ley de Patentes de 2015 ha incorporado algunas modificaciones relevantes en la regulación de los aspectos sustantivos del sistema de patentes español. En este trabajo se analizan esas modificaciones, con especial atención a las que se han producido en relación con las invenciones realizadas en el marco de una relación laboral o de servicios, el régimen de las invenciones universitarias, la excepción de uso reglamentario, el alcance de la protección concedida por la patente, el régimen de las acciones de defensa de la patente, la regulación de la patente como objeto de derecho de propiedad, la obligación de explotar, las licencias obligatorias, la nulidad y el reconocimiento de la limitación voluntaria de las reivindicaciones. 

The new 2015 Spanish Patent Law has brought about significant amendments to the regulations on the Spanish patent system. This article analyses the changes introduced, in particular, the new regime for inventions made by employees and service providers, university inventions, the Bolar exception, the scope of protection granted by patents, remedies for patent infringement, the patent as the subject matter of ownership rights, the obligation to work the invention, compulsory licences, patent nullity and voluntary limitation of patent claims.
