La Ley 15/2009, de 11 de noviembre, del contrato de transporte terrestre de mercancías, que ha entrado en vigor el pasado 12 de febrero de 2010, persigue modernizar el régimen legal aplicable a los contratos de transporte terrestre de mercancías por carretera y ferrocarril. Esta ley ha derogado los desfasados artículos 349 y siguientes del Código de Comercio, que han regido los contratos de transporte terrestre desde 1885, con apenas modificaciones. La Ley 15/2009 está inspirada en los convenios CMR y CIM, si bien el legislador ha tenido por conveniente regular distintas cuestiones no contempladas en dichos convenios. Los aspectos regulatorios del transporte terrestre y sus actividades auxiliares y complementarias continuarán regidas por la Ley de Ordenación de los Transportes Terrestres de 30 de julio de 1987 y por su Reglamento de 28 de septiembre de 1990. No obstante, aquellas disposiciones de estas normas que se opongan a lo dispuesto en la Ley 15/2009 se entenderán derogadas.

The Law on Contracts for the Land Transport of Goods (15/2009), which entered into force on February 12 2010, is designed to modernize the legal framework governing contracts for land transport of goods by road and rail. The law replaces the out of date Articles 349 et seq. of the Commercial Code, which have governed contracts on land transport since 1885, with few modifications. The new law is inspired in the CMR and CIM conventions, although the lawmaker has deemed it appropriate to regulate certain matters which are not contemplated in said conventions. The regulatory aspects of land transport and its auxiliary and complementary activities will continue to be governed by the July 30 1987 law and by the subsequent regulation of September 28 1990 on land transport. However, provisions that conflict with the new law will be revoked.
