En el artículo se exponen las principales cuestiones jurídico-patrimoniales relacionadas con la tutela del menor. Se presentan los distintos intereses que concurren en las relaciones jurídico-patrimoniales a que da lugar la tutela del menor y las funciones que corresponde desarrollar al tutor. Se describen las figuras de la administración de los bienes del menor y de la representación legal del menor. Se opera una delimitación objetiva de los bienes sustraídos a la administración del tutor. Se describe cómo debe ser la actuación del tutor y se presenta el régimen de vigilancia y prohibiciones sobre esa actuación. Seguidamente se desarrollan las restricciones a la actuación del tutor y se detallan los actos del tutor que están sujetos a autorización judicial. Se concluye mediante una reflexión acerca del difícil equilibrio que existe entre la autonomía del tutor y el necesario control judicial.

This article focuses on the fundamental legal and ownership-related issues on the guardianship of minors, beginning with an examination of the diverse interests implicated in connection with ownership, guardianship of minors, and the legal responsibilities of guardians. The article examines the legal concepts of the administration of minors’ assets and their legal representation and offers an objective definition of assets falling outside the legal scope of the guardian’s administration. The discussion turns to an explanation of the manner in which guardians should act and it describes the supervisory framework and prohibitions in connection with such actions. The article then presents the legal restrictions on the action of the tutor and it features the actions of the tutor that are subject to judicial authorization. The article concludes by reflecting on the problematic balance between the autonomy of the guardian and the necessity of judicial control.
