En el presente artículo se analiza la infracción de la ley, haciendo alusión a algunas cuestiones novedosas como la de si podría existir una justificación "legal" del fenómeno de la desobediencia civil, si cabe hablar de objeción de conciencia "de los jueces" ante las leyes injustas, si podría en alguna circunstancia la "guerra ser justa" o si no es mejor abandonar la punición y tender a la privatización y la "conciliación" en el Derecho penal.

In this paper, we study the infraction of the law, specially in relation with new problems, such as the possible "legal" justification of civil disobedience, or the possibility of a conscientious objection "of the judges", or of talking of a "justified war", as well as the current sustitution of punishment by a "private" criminal law.
