Tras la entrada en vigor de la Convención internacional sobre la protección de los derechos de todos los trabajadores migratorios y de sus familiares ya existe un tratado internacional en el ámbito de las migraciones y los derechos humanos de más amplio alcance y consideración. Sin embargo, el reconocimiento y la garantía de los derechos de los inmigrantes junto al paradigma de la nacionalidad todavía plantean demasiados desafíos normativos y compatibilidades con el estándar internacional de derechos humanos. Desde el ámbito internacional y nacional, las críticas se han centrado sólo en el escaso número de ratificaciones pero el objetivo de este trabajo es intentar analizar la verdadera causa de su posible fracaso revisando el alcance y las limitaciones existentes en el contenido y titularidad determinado por la Convención.

After the entry in force of the International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families already exists one of the most comprehensive international Treaties in the field of migration and human rights. Despite this, the recognition and guarantee of the migrant’s rights and the national paradigm have still represented too many normative challenges and compatibilities with the international minimum standard. From international and national level, the criticism has only focused on the few number of ratifications but the aim of this work tries to analyze the truth leit motiv of its possible failure on reviewing the entail and the limits with regard to the content and the right holders determinated in the ICRMW
