Este trabajo analiza el nacimiento del Estado moderno en España desde la problemática de la Justicia. Los procesos judiciales de la primera mitad del siglo XIX muestran los mecanismos por los cuales el aparato judicial del absolutismo no aceptaba la igualdad jurídica del liberalismo. Un entramado personal formado en el mundo local, escenario ideal del nuevo marco de representación pública, que sirve también para observar las estrategias de resistencia ante los nuevos proyectos constituyentes .

This work explains the transition from the Ancien règime to the liberal system in Spain focused in the Court administration. The judicial proceedings of the first half of the 19 th century show the reasons why the judicial system of the absolutism did not accept the legal equality of liberalism. A personal network formed in the local world –ideal setting for the new context of public representation– that also serves to observe the strategies of resistance to the new constitutional framing projects.
