En diciembre de 2012, el Comité Europeo de Derechos Sociales emitía una decisión en la que establecía los límites a medidas restrictivas del contenido esencial del derecho a la pensión. Esta decisión tiene gran trascendencia jurídica en la medida en que la CSE está presente tanto en el Derecho de la Unión, como en algunos derechos nacionales. Sin embargo, también plantea algunos interrogantes sobre sus efectos. Por una parte, porque la CSE responde a unas coordenadas distintas a las del proyecto europeo. Esta circunstancia ha sido determinante en la lábil recepción de la Carta social por los Tratados europeos. Por otro lado, porque los parámetros europeos también forman parte de los ordenamientos internos, infiltrando las prerrogativas de un constitucionalismo de mercado que pone límites a la dimensión social nacional.

On 7 December 2012, the European Committee of Social Rights issued a decision establishing the limits to a restrictive measures of the essence of the right to pension. This decision has a great legal importance because the European Social Charter is part of the Union law, as well as of some national rights. However, this decision also sets out some questions about its effects. On the one hand, because the European Social Charter is linked to a coordinates opposite to those of the European project. This circumstance determines the weak reception of the Social Charter by the European Treaties. On the other hand, because the European parameters are also part of the national orders, infiltrating the prerogatives of the European market constitutionalism that limit the national social dimension.
