Cuatro recientes sentencias de la Corte Interamericana de Derechos Humanos han vuelto a suscitar cuestiones relativas al derecho de los pueblos indígena sobre sus tierras, territorios y recursos. El artículo aborda el tratamiento del derecho a la propiedad colectiva o comunitaria y a la consulta a fin de obtener el consentimiento libre, previo e informado, con carácter general y en estas sentenciasen particular, como derechos instrumentales para garantizar el efectivo disfrute de sus tierras, territorios y recursos por parte de las comunidades indígenas y tribales.

Four recent judgments of the Inter-American Court of Human Rights haveonce again raised issues relating to the rights of indigenous peoples over theirlands, territories and resources. The article addresses the treatment of the rightto collective or communal ownership and the right to consultation in order toobtain free, prior and informed consent, in general and in these judgments in particular, as instrumental rights to guarantee the effective enjoyment of theirlands, territories and resources by indigenous and tribal communities
