El artículo toma en consideración el papel que la Corte constitucional italiana asigna a la intención del legislador. Se pone de manifiesto cómo, a través del análisis de los criterios interpretativos del “respeto a la norma de derecho vivo” y de la “interpretación conforme a Constitución”, así como de su contraste con la jurisprudencia relativa a la interpretación auténtica, resulta que el puesto de la intención del legislador, (desde la perspectiva de su actualidad), debe considerarse central.

The paper takes into account the role assigned to legislator’s intention by the Italian constitutional Court. It is shown how, through an analysis of the interpretative criteria of ‘respect to the living law’s norm’ and ‘interpretation in accordance with constitution’, as well as through their contrast with the case law about authentic interpretation, it works out that the role of legislator’s intention –from the perspective of its actuality– must be seen as a central one.
