Este artículo analiza las diversas posibilidades de incorporar al ordenamiento jurídico español los derechos de participación política, a partir de la distinción constitucional entre los derechos de sufragio y de acceso a la función pública y el resto de derechos de participación, como la reunión-manifestación, asociación, sindicación y huelga. A partir de estos dictados constitucionales, el artículo estudia las restricciones aplicables al voto y al acceso a la función pública y defiende el margen del legislador respecto del resto de derechos, sobre todo en la dirección de su reconocimiento.

This articles analyzes the different means to incorporate the rights of political participation to the Spanish legal system through the constitutional distinction between rights of suffrage and access to civil service and the rest of the rights of political participation, as the rights of assembly and manifestation, association, union and strike. From this constitutional frame, the article studies the restrictions set on suffrage and access to civil service, and defends the legislative discretion with regard to the rest of rights, specially about their acknowledment.
