El objetivo de este artículo es trazar un panorama de la recepción de Carl Friedrich von Savigny en España. Se trata de un estudio de historia de circulación de las ideas, un campo de investigación que busca explicar los procesos de adaptación de las teorías a contextos diversos a los originales, teniendo en cuenta que en ellos se suelen producir numerosas transformaciones. En este caso, veremos cómo el pensamiento de Savigny se recibió en España de la mano del nacionalismo y al hilo de la discusión sobre los derechos forales. En este clima político-jurídico, la interpretación de Savigny osciló entre el nacionalismo y el tradicionalismo, pero descuidó por completo la faceta del Savigny dogmático. También intentará demostrarse que la recepción del historicismo es previa a la del jurista alemán y que éste, por lo tanto, no hizo sino fortalecer tendencias ya existentes en España.

The purpose of this article is to outline the reception of Carl Friedrich von Savigny’s thought in Spain. This study should be framed in the comparative history of ideas, a field of research which aims at explaining the adaptation of theories to contexts which are different to the original ones, considering that many transformations usually take place in those processes. In this particular case, we will see how Savigny’s thought was received in Spain thanks to the nationalist movement and along with the debates about the special legal status of the historical regions. Because of this political environment, Savigny was interpreted as an exponent of nationalism and traditionalism, totally dismissing the role played by him in the legal dogmatics. We will also show that the reception of historicism in Spain is previous to the introduction of Savigny and that, therefore, he only contributed to strengthen already existing tendencies.
