Desde principios del siglo XXI, la orientación sexual y la identidad de género están siendo reconocidos como derechos del colectivo LGBTIQ por informes de organizaciones, documentos internacionales sobre derechos humanos y por sentencias judiciales. Estos derechos tienen por objeto evitar la discriminación de estas personas, la prohibición de la violencia y el odio y el pleno disfrute de los derechos y libertades fundamentales. Sin embargo, siguen existiendo grupos de personas, como los intersexuales, los transgénero, los queer, los no binarios, etc., que no se sienten identificados con la formulación de este derecho. Este artículo analiza los diferentes aspectos de este debate y explora la vía para la justificación de un derecho a la libre determinación del sexo.

Since the beginning of the 21st century, sexual orientation and gender identity have been recognized as rights of the LGBTIQ collective by reports from organizations, international documents on human rights and by court decisions. These rights are intended to prevent discrimination against these people, the prohibition of violence and hatred and the full enjoyment of fundamental rights and freedoms. However, there are still groups of people, such as intersex, transgender, queer, non-binary, etc., who do not feel identified with the formulation of this right. This article analyzes the different aspects of this debate and explores the way to justify a right to self-determination of sex.
