En un momento histórico de avances tecnológicos imparables, la humanidad dispone de grandes oportunidades y desafíos que debe gestionar. Así pues, en el presente estudio, partiendo de una introducción contextual se pretende llevar a cabo una profunda exégesis del artículo 183 del Código penal español, que castiga el delito de embaucamiento de menores o “child grooming”. Se realiza un estudio dogmático con apuntes criminológicos de los elementos estructurales del delito que indicamos con el sustento de la doctrina científica más actual y especializada, así como con la aportación de la jurisprudencia más relevante y representativa. Todo ello persigue, como corolario, la aportación de una de serie de conclusiones y propuestas, algunas de lege ferenda, para regular un delito que podemos afirmar que posiblemente ha pasado demasiado desapercibido ante la última y polémica reforma de los delitos contra la libertad sexual. 

In a historical moment of unstoppable technological advances, humanity has at its disposal some great opportunities and challenges to manage. Thus, in this study, starting with a contextual introduction, the aim is to carry out an in-depth exegesis of article 183 of the Spanish Criminal Code, which punishes the crime of child grooming. A dogmatic study is carried out with criminological notes on the structural elements of the crime that we indicate with the support of the most current and specialized scientific doctrine, as well as with the contribution of the most relevant and representative case law. The corollary of all this is the contribution of a variety of conclusions and proposals, some of them de lege ferenda, to regulate a crime which we can affirm that perhaps it has been too unnoticed in the face of the latest and controversial reform of crimes against sexual freedom.
