Uno de los cambios que se persigue en la nueva ley procesal penal es la incorporación  de la mediación en el proceso, de modo que se introduciría la justicia reparadora en el enjuiciamiento  criminal. De esta manera la justicia restaurativa se sitúa como un modelo que puede  convivir en un sistema principalmente retributivo, pero también rehabilitador pues ha de dirigirse  a la readaptación del delincuente. La mediación intraprocesal es vista como un modo de solventar,  en parte, las carencias del proceso, pues desde la Criminología y desde la Victimología se ha  comprobado que la víctima a través de este medio recobra el lugar que ha de tener en el conflicto,  pero no solo beneficia a la víctima, también al infractor ya que es un instrumento que facilita su  rehabilitación. 

One the changes pursed in the new criminal procedural law is the incorporation of  mediation in the process, so that restorative justice would be introduced in criminal prosecution. In  this way, restorative justice is positioned as a model that can coexist in a mainly retributive system,  but also a rehabilitative one, since it must be aimed at the rehabilitation of the offender. Intraprocedural  mediation is seen as a way to solve, in part, the shortcomings of the process, since from  Criminology and from Victimology it has been proven that the victim through this means recovers  the place that he has to have in the conflict, but it not only benefits the victim, but also the offender,  since it is an instrument that facilitates their rehabilitation.
