Una de las estructuras más complejas de la teoría del delito, es la de las causas de justificación, las cuales, y a pesar de la abundante bibliografía que existe sobre este tema, siempre dan lugar a profunda discusión dogmática. Así, algunos tópicos, que aparentemente ya se encontraban aclarados, vuelven al campo de la incertidumbre, en relación con los diversos puntos de vista que existen. En el presente artículo se plasman, a juicio del autor, las diversas funciones que juegan las causas de justificación, así como las diferencias con base en la teoría de las normas entre causas de exclusión y de justificación.

 One of the most complex structures inserted in crime theory is that of the causes of justification; in relation to these, there are always controversial areas that give rise to dogmatic discussion, even taking into consideration the abundant literature existing on this subject nowadays. Indeed, some topics that apparently have been duly clarified become uncertain again, particularly as quite different points of view may arise involving general criminalistic theories. According to the author’s view, the role of the causes of justification in the theory of crime, as well as the differences that operate between causes of exclusion and justification based on the theory of the legal norm, are widely and accurately analyzed in the present article.
