La nueva regulación del decomiso, y la presunción que se realiza respecto a las adquisiciones a título lucrativo por parte de terceros plantea controversia con algunas figuras, como ocurre con el partícipe a título lucrativo. El partícipe a título lucrativo es un tercero que no ha tenido participación en el delito, sino que simplemente se ha lucrado de este, por lo que es una figura compatible con la buena fe. Este trabajo tiene como objetivo analizar las semejanzas y diferencias entre ambas figuras. 

 

The new regulation of confiscation, and the presumption that is made regarding acquisitions for profit by third parties raises controversy with some figures, as occurs with the participant for profit. The participant for profit is a third party who has not participated in the crime, but has simply profited from it, so he is a figure compatible with good faith. This work aims to analyze the similarities and differences between both figures.
