El presente trabajo tiene por objeto reflexionar sobre la actuación del agente encubierto tras la última reforma producida en la Ley de Enjuiciamiento Criminal. Con este objetivo se analizarán los aspectos centrales que presiden la regulación de esta figura, tales como el ámbito subjetivo y objetivo de la infiltración policial; el procedimiento; la limitación adicional de derechos fundamentales; el valor probatorio que puede llegar a alcanzar su actividad y la provocación del delito.

The aim of this paper is to reflect on the role given to the undercover agent after the latest reform of the Criminal Procedure Law. With this objective, the main aspects of the new powers given to this police agent will be analyzed, such as the subjective and objective scope of the police infiltration; the new procedure that they should follow; the additional limitation of fundamental rights; the probative value of the evidence obtained, and the provocation of the crime.
