La Constitución y las normas internacionales reiteran que se deben propiciar fórmulas para asegurar la participación de la sociedad en la administración de la justicia penal. Este principio del Estado social de Derecho compromete también al sistema penitenciario. España experimentó a lo largo del siglo XIX algunos modelos para acercar la sociedad a las prisiones, pero hoy se han abandonado. La Orden de creación del consejo social penitenciario (INT/3191/2008), aunque se ha querido presentar como heredera de esa tradición responde a objetivos distintos. Seguimos, en consecuencia, pendientes de implementar una fórmula que tiene unos fundamentos preventivos muy destacables.

The Constitution and international standards reiterate that formulas must be provided to ensure the participation of society in the administration of criminal justice. This principle of the social and law State also compromises the penitentiary system. Throughout the 19th century, Spain experimented with some models to bring society to prisons, but today they have been abandoned. The Order for the creation of the social penitentiary council (INT/3191/2008), although it has wanted to present itself as the heir of that tradition, responds to different objectives. We continue, therefore, without having a formula that has very notable preventive foundations.
