In the frame of the problems concerning the desistance of the attempt, it is interesting to consider the question of the possibility to admit the desistance when the criminal becomes aware of his error on the victim’s identity during the crime execution or, once this was finished, before the result takes place. In order to solve this question, the appropriateness of the figure of the ruined attempt or of the requirement of willfulness are analyzed, as well as the peculiarities shown by the error perceived after the conclusion of one’s attempt.
