El presente artículo estudia la institución de la alevosía convivencial, también denominada alevosía doméstica, que se ha configurado como una especie de alevosía determinada por la comisión del delito en el domicilio de la víctima por parte de personas con las que ésta convive, por encontrarse despreocupada y por lo tanto indefensa frente a un eventual ataque. En este artículo se valora y critica la institución, tanto desde una perspectiva general como en el marco de la violencia de género, y se abordan las objeciones sociales y jurídico-penales a la figura así como posibles soluciones a éstas. Por último, se propone una refundación de la figura como parte integrante de la valoración general de la alevosía.

This article studies the institution of convivial treachery, also called domestic treachery, which has been configured as a kind of treachery determined by the commission of the crime in the victim’s home by people with whom it lives, because of being carefree and therefore defenseless in the face of an eventual attack. In this article the institution is valued and criticized, both from a general perspective and in the context of gender violence, and social and legal-criminal objections to the figure are addressed as well as possible solutions to them. Finally, a refounding of the figure is proposed as an integral part of the general assessment of treachery.
