En este artículo se tratan de determinar los presupuestos fáctico y lógico-valorativo previos y necesarios para poder determinar el alcance de una serie de conductas alternativas descritas en el artículo 274 CP (apartados 1 y 2) relativas a la protección penal de los derechos de propiedad industrial registrables. Desde la perspectiva fáctica del delito se delimita el objeto material, consistiendo éste exclusivamente en la marca y el nombre comercial, al ser estos signos distintivos los únicos registrables de acuerdo a la legislación mercantil sobre marcas. Desde una perspectiva lógico-valorativa se afirma que aún reconociendo otros valores que puedan verse afectados, la descripción típica y la relevancia del consentimiento del titular del signo distintivo registrado, el bien jurídico protegido se concreta en el derecho de exclusiva del titular de la marca o del nombre comercial por su titular.

The aim of this article is to determine the factual and logic-valuing requirements prior and necessary in order to establish the reach of a number of alternative behaviors displayed in the article 274 (paragraphs 1 and 2) of the Spanish Criminal Code, concerning the penal protection of the rights to recordable industrial property. The material object is delimited from the factual perspective of the crime, this consisting only of the brand and the commercial name, as these distinctive signs alone can be recorded according to the commercial law on brands. From a logic-valuing perspective it is sustained that, even recognizing that other values can be affected, such as the typical description and the relevance of the consent of the holder of the distinctive sign, the specifically protected juridical good is the right to exclusivity of the holder of the brand or the commercial name.
