Los poderes ejecutivo, legislativo y judicial se hallan encomendados a personales naturales. A la vista de la independencia del poder judicial, la diferenciación entre el Poder judicial, como tercer poder del Estado, y los jueces debe ser tenida en cuenta. En Alemania, los jueces disfrutan de independencia y actúan de manera independiente, pero en cambio no existe un Poder judicial independiente: no pueden, por ello, evitarse las contradicciones.

Executive, legislative und judiciary powers are carried out by natural persons. Regarding the independence of the judiciary power, the differentiation between judiciary as third state power and judges has to be observed. In Germany, judges enjoy independence and act independently, but an independent judiciary does not exist: Contradictions can not be avoided.
