El objetivo de este artículo consiste en analizar los razonamientos empleados por Michael Walzer al abordar uno de los principales problemas de las llamadas “intervenciones humanitarias”. Me refiero al supuesto conflicto entre varios principios del actual Derecho internacional: por un lado, los relativos al respeto de la soberanía de los Estados, la prohibición del uso de la fuerza y la no intervención y, por otro, el de protección de los derechos humanos. Expondré los principales argumentos a favor de la intervención humanitaria propuestos por nuestro autor y las críticas que él mismo ha contestado. Haré una breve referencia a la evolución del Derecho internacional sobre este tema y finalizaré presentando varias conclusiones críticas.

The aim of this article consists of analyzing the reasonings used by Michael Walzer in discussing one of the main problems of the so called “humanitarian interventions”. I refer to the alleged conflict between several principles of the current International Law: on the one hand, the relative ones with regard to the sovereignty of the States, the prohibition of the use of the force and not intervention and, on the other hand, the protection of the human rights. I will expose the principal arguments in favour of the humanitarian intervention proposed by our author and the critiques that he has received and his responses thereto. I will make a brief reference to the evolution of the International Law on this issue and will finish presenting several critical findings.
