El trabajo se divide en cinco partes: 1) Análisis filosófico-jurídico de la memoria post-Auschwitz para entender el presente acudiendo al pasado, a fin de mirar prudentemente el futuro en el Estado de derecho. 2) Estudio del consenso y el lenguaje de la posguerra, entendido el primero como un concepto sobrevalorado, pero también como un elemento necesario para determinar el derecho. 3) Tomar como punto de partida el consenso posterior a la posguerra, situado en el contexto del discurso del odio. Se intenta justificar el delito de negacionismo como forma de reconciliarnos con nuestro pasado. 4) Repensar la memoria para entender el derecho a través del pasado a fin de conseguir un presente razonable y un futuro auténtico. 5) Por último, se señalan algunas conclusiones. 

The paper is divided into five sections: 1) Philosophical and legal analysis of the memory after Auschwitz to understand the present returning to the past, so prudently look to the future in the rule of law. 2) Study of the consensus and language after the Second World War, understood the first as an overrated concept, but also as a necessary element to determine the law. 3) The starting point is the consensus after the postwar period set in the context of hate speech. It intends to justify the denial of Holocaust as a way to reconcile with our past. 4) Rethinking memory to understand the law across the past, and accomplish a reasonable present and authentic future. 5) Finally, the last part indicates some conclusions.
