Algunas constituciones, como la brasileña, establecen cláusulas pétreas como límites a las reformas constitucionales. Las cláusulas pétreas son concebidas para garantizar, de forma aún más firme, el ordenamiento constitucional y su necesaria estabilidad. Por eso, las cláusulas pétreas son consideradas obstáculos que sólo pueden ser superados a través del rompimiento del orden constitucional vigente. Este estudio busca justificar y demostrar la posibilidad de superar jurídicamente las cláusulas pétreas, sin que haya la necesidad de elaborar un nuevo texto constitucional, evitándose así, los desgastes y los riesgos inherentes a la sustitución del ordenamiento jurídico.

Some constitutions, such as the Brazilian one, establish immutable clauses as limits on constitutional reforms. The immutable clauses are made to guarantee, in a stronger form, the constitutional ordering and its needed stability. Hence, the immutable clauses are considered as obstacles that can only be overcome through the breaking act of the current constitutional order, in front the elaboration of a new Constitution. This research analyses the possibility of juridical surpassing the immutable clauses, without the necessity of making a new constitutional text, avoiding this way the risks resulted from the substitution of the juridical order.
