Los particulares también pueden invocar el derecho a la tutela judicial efectiva cuando sus relaciones jurídico privadas presentan algún elemento internacional. Access to justice is a fundamental right also when the parties are involved in a trans-frontier relationship. Thus, access to national courts is as fundamental as the right to have a foreign judgment recognized in the forum. An adequate system of judicial cooperation in civil matters between authorities is also necessary both as the proceedings are pending at the forum (i. e. searching for evidence abroad) or when the foreign authority seeks for cooperation in a proceeding the result of which is likely to be recognized or enforced in the forum. The more trust there is among States, the higher the degree of cooperation. Thus, the maximum collaboration will be reached between States in integrated areas. However, even in default of such integration, the State is obliged to provide for such cooperative behaviour within certain constitutional limits. Any future text which tackles this issue should be built upon these ideas and should endeavour to offer a complete system which fulfils the present lacunae in the Spanish legal order.
