El juramento necesario era un medio para la finalización del proceso en el proceso romano. Como institución jurídica-procesal dispositiva de la pretensión, cabe preguntarse si todos podían acceder a este recurso, o bien se exigía una determinada capacidad de obrar. En este artículo sostendremos que, mientras que la capacidad para prestar el juramento es universal, la capacidad para ofrecer/referir/remitir el juramento está limitada.

The necessary oath was a means for the completion of the process in the Roman process. As a legal-procedural institution disposing of the claim, it may be asked whether this remedy was available to all, or whether a certain capacity to act was required. In this article, we will argue that while the capacity to take the oath is universal, the ability to off er/refer/exempt the oath is limited.
