El concepto “Orden Público” goza de una fuerte presencia en la cultura política de las sociedades democráticas modernas. No obstante, si bien el término puede ser entendido y aceptado con relativa facilidad por cualquier ciudadano de a pie, su defi nición resulta extraordinariamente compleja para el entorno de las ciencias políticas o de la teoría del derecho. Concretamente, nuestro ordenamiento hace continua referencia a esta fi gura sin ofrecernos una defi nición objetiva. El hecho de que el “Orden Público” sea actualmente concebido como un principio jurídico relativamente indeterminado no constituiría un problema si no estuviéramos hablando de un elemento que desarrolla una clara función directiva en la actividad de toda administración democrática moderna. Este paradigma jurídico y social imposibilita cerrar el continuo debate sobre la coincidencia entre los fi nes últimos del Estado y el bienestar de la comunidad. Así pues, la cuestión principal a tratar se centra en concretar qué es lo que cualquier ciudadano de a pie puede entender por “Orden Público”, cual es su contenido o componente esencial, y en qué manera esta fi gura puede infl uir legítimamente en el desarrollo y disfrute de los derechos que constitucionalmente le han sido atribuidos.

The term “Public Order” has a strong presence in the political culture of modern democratic societies. But if the term can be understood and accepted very easily by any normal citizen, his defi nition is too complex for political science or theory of law. Specifi cally, our system makes continual reference to this fi gure without offering an objective defi nition. The fact that the “Public Order” is currently conceived as an undefi ned legal principle is a problem because we are talking about an element that directs the activity of modern democratic governance. This legal and social paradigm makes it impossible to close the ongoing debate about the overlap between the ultimate goals of the State and welfare of the community. So the main issue to deal focuses in particular that is what any ordinary citizen can understand, “Public Order”, which is its content or essential component, and how this fi gure can legitimately infl uence the development and enjoyment of constitutionally have been allocated.
