El trabajo pretende señalar las fricciones y dificultades que se dan en materia legislativa- tecnológica respecto a la excepción por copia privada, comenzando por el análisis de la jurisprudencia del TJUE. Posteriormente, se estudiarán y compararán los sistemas de compensación español y británico. Mediante este análisis se pretenden mostrar las problemáticas presentes en el sistema europeo, evidenciados por la trayectoria legislativa de ambos países. A continuación se exponen algunos de los más acuciantes defectos que acarrea el sistema supranacional de compensación, para proponer alternativas tanto de legislación, como de financiación y hasta de enfoque de la excepción por copia privada. El estudio procura así plantear una reinvención de la regulación actual, cuya cuasi obsolescencia y trabas son recurrentes a lo largo del contenido del mismo.

The paper intends to point the frictions and difficulties regarding the exception for private copying, from a legislative and technologic perspective. The analysis begins with the study of the caselaw of the European Court of Justice, followed by the examination and comparison of the Spanish and British systems of compensation. The analysis aims to show the issues present in the European system, highlighted by the legislative process of both countries. Hereafter, some of the more pressing defects of the supranational system of compensation will be exposed, so that legislative, fi nancing and approach alternatives can be off ered for the exception for private copying. This essay seeks to propose a reinvention of the current regulation, as well as exposing its obsolescence and hurdles.
