El presente trabajo tiene como propósito reflexionar acerca de la Gestación por Sustitución desde las teorías feministas, y respecto a la forma en que dichos enunciados son traducidos en proclamas de defensa o rechazo ante una regulación normativa. El objeto fi nal es pensar de qué manera se pueden utilizar dichos insumos para construir una necesaria regulación en un contexto de vacío e inseguridad normativa.

The purpose of this paper is to discuss about gestational surrogacy motherhood agreements from the point of view of feminist theories, and the way in which these statements are translated into arguments for or against a regulation. The fi nal aim is to think the way in which this argument could be construed in order to create the required regulation in a context of legal vacuum and regulatory uncertainty.
