El presente trabajo tiene como objeto de estudio la medida legal que establece cuotaselectorales para cada sexo en las candidaturas electorales, como por ejemplo lo establece la LeyOrgánica 3/2007 en España. Se analizan los argumentos que se refi eren a la supuesta vulneraciónde los derechos fundamentales de sufragio pasivo y activo. La investigación ha tenido en cuentaespecialmente la Sentencia 49/2003, de 10 de febrero, de la Corte Constituzionale italiana y laSentencia 12/2008, de 29 de enero, del Tribunal Constitucional español, ambas sobre la constitucionalidadde ciertas medidas legales que establecieron cuotas electorales en los respectivospaíses. Conforme a argumentos analizados, se concluye que la norma estudiada no vulnera elderecho fundamental de sufragio pasivo o activo.

This work is concerned with the legislation that establishes a gender-based quotasystem on the electoral lists, as it was introduced by a Spanish law (Ley Orgánica 3/2007). Thearguments that refer to a supposed violation of active and passive’s fundamental right of suffragewere analyzed. This study was based mainly according to the Decision 49/2003, given on the10th of February by the Italian Constitutional Court and Decision 12/2008, given on the 29th ofJanuary by the Spanish Constitutional Court. Both decisions are related to the constitutionalityof certain laws that have established electoral gender-based quotas in these countries. The resultfrom this analysis leads to the conclusion that the legislation studied does not violate the activeand passive’s fundamental right of suffrage.
