La aprobación del Pacto Verde Europeo y la introducción de objetivos medioambientales más ambiciosos han supuesto la priorización del desarrollo de las energías renovables en el territorio de la Unión Europea, traduciéndose en regulaciones que, a pesar tratar de garantizar la descarbonización de la economía, en ciertas ocasiones terminan alejando la consecución de este objetivo. Es decir, en su afán por regular la materia en cuestión, la Unión Europea incurre en el riesgo de sobrerregularla. En este trabajo, se estudia el caso del hidrógeno renovable y si, efectivamente, padece este problema, en cuyo caso se propon drán recomendaciones para solventarlo. Asimismo, se señalarán las bases legales que permiten fundamentar la competencia exclusiva de la Unión con el fin de que la toma de decisiones referentes a determinados casos sea efectiva y se eviten los problemas de consenso intrínsecos a la Unión Europea.

The approval of the European Green Deal and the introduction of new and more ambitious environmental goals has led to the prioritization of renewable energies, which translates to regulations that, despite trying to guarantee the decarbonis ation of the economy, in some situations end up pushing this objective further away. In other words, in its effort to regulate this matter, the European Union incurs the risk of overregulating it. The case study for this paper is renewable hydrogen and whether it is affected by this problem. In case it is, this paper will aim to propose recommendations for its solution. Likewise, the legal bases that allow the exclusive competence of the Union to be established will be pointed out so that decision-making regarding certain cases is effective and problems of consensus intrinsic to the European Union are avoided.
